2Using this website
Link to section 22.1Information only
The Website presents BARIQ, our holiday homes and our holiday home management services. Its content is general information. It is not an offer that can be accepted, and it does not by itself create a contract between you and BARIQ.
2.2Demonstration listings and illustrative photographs
Homes marked as demonstration listings, and photographs marked or described as illustrative (including images from third-party photo libraries), show the style and standard of the homes we offer. They are not specific homes available to book. The description, photographs, amenities, capacity and rate of an actual home are confirmed to you directly before you book.
2.3Rates and availability
Any rate, availability, fee or other detail shown on the Website, or given to you by WhatsApp, telephone or email before a Booking Confirmation, is indicative and may change. It becomes binding only when it is set out in a Booking Confirmation.
2.4Accuracy and availability of the Website
We take care to keep the Website accurate and up to date, but we cannot promise that it is complete, current or free of errors, or that it will always be available. We may change, suspend or withdraw any part of it at any time.
2.5Intellectual property
The BARIQ and بريق names and logos, the design of the Website and its text belong to BARIQ or are used with permission. Photographs from third parties remain the property of their owners. You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, republish or commercially use any part of the Website without our prior written permission.
2.6Acceptable use
When using the Website, you must not:
- use it in any way that is unlawful, fraudulent or harmful;
- submit false information, or another person's details without their permission;
- send unsolicited advertising or spam through our forms or contact channels;
- attempt to gain unauthorised access to the Website, its servers or any connected system, or interfere with its security or operation; or
- introduce viruses or other harmful code, or collect content or data from the Website by automated means without our permission.
2.7Third-party services and links
The Website links to services that BARIQ does not control, including WhatsApp (operated by Meta), booking platforms, maps, and email and telephone apps. Their own terms and privacy policies apply when you use them, and we are not responsible for their content, availability or practices. When you choose WhatsApp, the Website only opens WhatsApp with a suggested message: nothing is sent to us until you press Send.
3Booking a stay
Link to section 33.1How to request a stay
All bookings are handled personally by our team. To request a stay, contact us on WhatsApp at +971 55 220 9959 (opens in a new tab). The booking and inquiry buttons on the Website open WhatsApp with your details prefilled, and you can also use our inquiry form or email us. The Website does not take bookings or payments online. A request, an inquiry, or a message from us suggesting homes or rates is not a booking.
3.2When your booking is confirmed
Your booking is confirmed only when both of the following have happened:
- we have sent you a written Booking Confirmation, by WhatsApp or email, setting out the home, the dates, the number of guests, the total price and what it includes, any fees and government charges, the payment terms, any security deposit, and the cancellation and refund terms; and
- we have received the payment required by the Booking Confirmation within the time it states.
Until then, the home is not reserved for you and may be booked by someone else. If a required payment is not received in time, we may release the dates.
3.3Your agreement for the stay
Your Booking Confirmation, these terms and any house rules we give you together form the agreement for your stay. If they conflict, the Booking Confirmation prevails.
3.4Prices, fees and government charges
Prices are in UAE dirhams (AED) unless we state otherwise. Your Booking Confirmation shows any VAT and government fees that apply, such as the Tourism Dirham fee charged per bedroom, per night under Dubai regulations, which we collect and pay to the authorities where required. If the law introduces or changes a tax or government fee after your booking is confirmed, we may apply the change as the law requires, and we will tell you before your stay.
3.5Guest registration and identification
Dubai regulations require holiday home guests to be registered with the competent authorities. Before check-in, you must give us a valid passport, or an Emirates ID for UAE residents, for every guest who will stay, and the guests must be those named in the booking. If the required identification is not provided, or the information given is false, we may refuse check-in, and the cancellation terms of your Booking Confirmation will apply. We handle identity documents as described in our Privacy Policy.
3.6The lead guest
The person who makes the booking must be of legal age to enter into a contract and must stay at the home. They are responsible for every member of their party, and for their visitors, complying with these terms.
3.7Occupancy and house rules
The number of guests may not exceed the maximum stated in your Booking Confirmation, and no additional people may stay overnight without our prior written approval. During your stay, you and your party must follow the house rules, the rules of the building and community, and the laws of the United Arab Emirates, including rules on noise, smoking, pets and the use of shared facilities. Parties, events and commercial photography or filming are not permitted unless we have agreed to them in writing in advance.
If a guest seriously breaches these rules, for example by exceeding the permitted occupancy, holding a party, acting unlawfully, putting people or property at risk or seriously disturbing neighbours, we may end the stay, after a warning where reasonable. To the extent permitted by law, no refund is due for the remaining nights in that case.
3.8Check-in and check-out
Check-in and check-out times are those in your Booking Confirmation. Early check-in or late check-out is possible only if we agree to it in writing, and may carry a charge. Please leave the home in a reasonable condition and return all keys, cards and access devices.
3.9Security deposit and damage
A refundable security deposit may be required, as stated in your Booking Confirmation. You are responsible for loss of or damage to the home, its contents and the building's shared areas caused by you, your party or your visitors, beyond normal wear and tear, and for any fines or charges imposed by the building management or the authorities because of their conduct. We may deduct reasonable, documented costs from the deposit and will return the balance within the period stated in your Booking Confirmation. If the costs exceed the deposit, you must pay the difference.
3.10Cancellation by you
If you cancel or change a confirmed booking, the cancellation and refund terms in your Booking Confirmation apply. These terms can differ between homes and dates, so please read them before you pay.
3.11Changes or cancellation by BARIQ
We may need to change or cancel a confirmed booking for reasons of safety, legal or regulatory requirements, an instruction from the authorities or the building management, serious damage to or failure of the home, or a force majeure event. We will tell you as soon as possible and, where we can, offer an alternative home of a similar standard. If you do not accept the alternative, or none is available, we will refund the amounts you paid for the nights we do not provide.
3.12Bookings through booking platforms
If you book a BARIQ home through a third-party booking platform, that platform's terms, payment arrangements and cancellation policy also apply to your booking.
3.13During your stay
If anything in the home is not as it should be, please tell us promptly so that we can put it right. We will respond within a reasonable time.
4Holiday home management for property owners
Link to section 44.1Our services
BARIQ offers holiday home management to owners of residential properties in Dubai: we prepare, market and operate a Property as a holiday home on the Owner's behalf. The services for each Property are agreed in its Management Agreement and may include:
- Furnishing and interior design: guidance on, and coordination of, furnishing and styling the Property to a holiday-home standard. Purchases and works are made only with the Owner's prior approval and at the Owner's cost, unless the Management Agreement says otherwise.
- Photography and listing preparation: professional photography arranged, descriptions written and listings prepared.
- Publishing and distribution: publishing the Property on BARIQ's own website and platform, on third-party booking platforms such as Airbnb and Booking.com, and through BARIQ's network of brokers and partners.
- Pricing strategy: setting and reviewing nightly rates in light of seasonality, demand and events.
- Guests and bookings: guest communication, reservations and calendars, check-in and check-out, and guest registration with the authorities.
- Housekeeping and property care: coordinating cleaning and linen between stays, regular checks, and maintenance by contractors.
- Reporting: regular statements of bookings, Rental Revenue, fees and expenses.
4.2Booking platforms and brokers
Third-party booking platforms are independent businesses. Their terms, fees and commissions, search rankings and algorithms, payout timings and decisions, including suspending or removing a listing, are outside BARIQ's control, and we are not responsible for them. Naming a platform on the Website does not mean that it endorses or partners with BARIQ. Where we work with brokers or partners to market a Property, we coordinate them as set out in the Management Agreement.
4.3What the Owner is responsible for
Unless the Management Agreement says otherwise, the Owner confirms, and remains responsible for:
- being the registered owner of the Property, or legally authorised to appoint BARIQ, and having any consent required from co-owners and from any bank or mortgagee;
- providing the documents needed to register and permit the Property as a holiday home and to operate it, such as the title deed (or the sale and purchase agreement and developer documents where no title deed has been issued), identification, utility account details, and any no-objection certificate (NOC) or approval required by the developer, the building management or the owners' association;
- making sure that short-term letting is permitted for the Property, and complying with the rules of the building, the community and the owners' association;
- keeping the Property safe and in good repair, including its fire and life-safety equipment, and maintaining suitable insurance for the Property and its contents that covers holiday-home use;
- paying service charges, utilities, community fees, permit and registration fees, maintenance and other property costs; and
- giving us accurate information about the Property and telling us promptly about anything that affects its use.
4.4The Management Agreement
Our services for a Property begin only after a written Management Agreement for that Property has been signed and the Property has been registered or permitted as the regulations require. The Management Agreement sets out the services, the fee percentage, its duration and notice period, the Owner's own use of the Property, payment arrangements and other terms. If the Management Agreement differs from these terms, the Management Agreement prevails. Website content, consultations, proposals and estimates are not agreements.
4.5Our relationship with the Owner
BARIQ provides its services to the Owner as an independent service provider and acts on the Owner's behalf only to the extent set out in the Management Agreement. Nothing in these terms or on the Website creates a partnership, joint venture or employment relationship between BARIQ and an Owner; words such as "partner" on the Website are used in their everyday sense. The Property, and the furniture and items bought for it at the Owner's cost, remain the Owner's property.
5Management fees
Link to section 55.1Our fee
BARIQ's management fee is between 20% and 25% of the Rental Revenue of each Property. The exact percentage for each Property depends on the Property and the services agreed, and is fixed in writing in its Management Agreement.
5.2What Rental Revenue means
Unless the Management Agreement defines it differently, Rental Revenue means the accommodation charges paid by Guests for stays at the Property, excluding:
- value added tax (VAT);
- the Tourism Dirham fee and other government fees and charges;
- refundable security deposits; and
- any amounts refunded to Guests.
The Management Agreement sets out how other charges collected from Guests, such as cleaning fees, are treated, and how booking platform commissions and any commission payable to brokers are handled.
5.3VAT
Our fees are exclusive of VAT, which is added where applicable at the prevailing rate.
5.4Collection and payment to the Owner
Where BARIQ collects Rental Revenue, we may deduct our fee and any expenses approved by the Owner before paying the balance to the Owner, together with a statement, at the intervals set in the Management Agreement.
5.5Costs paid by the Owner
Unless the Management Agreement says otherwise, the costs of furniture, furnishing and fit-out, repairs and maintenance, consumables and guest supplies, utilities, service charges, permits and registration, and insurance are paid by the Owner. We seek the Owner's approval before incurring costs above any limit set in the Management Agreement, except in an emergency that affects safety or to prevent further damage.
5.6Other charges
We charge only the fees set out in the Management Agreement or otherwise agreed with the Owner in writing.
6No guarantee of occupancy, income or returns
Link to section 6BARIQ does not guarantee occupancy, bookings, rates, income or returns.
- We do not guarantee any level of occupancy, including full or 100% occupancy.
- We do not guarantee any number of bookings or nights booked.
- We do not guarantee any nightly or average rate.
- We do not guarantee any amount of rental income, revenue, profit or return.
6.1Our commitment
We exercise reasonable professional care and skill in preparing, marketing and operating each Property, and we work towards the best return that the Property can achieve. Our obligation is an obligation of means, to make reasonable, professional efforts, and not an obligation of result.
6.2Estimates are not promises
Any estimate, projection, comparison or example of rates, occupancy or income, whether on the Website, in a consultation, in a proposal or in a message, is indicative only. It is based on the information available at the time and is not a promise or guarantee of future results.
6.3Factors outside our control
Results depend on many factors outside BARIQ's control, including:
- market demand and seasonality;
- competition from other homes and hotels;
- the Property's location, view, size, condition, furnishing and amenities;
- the rules of the building and the community;
- the policies, fees, rankings and algorithms of booking platforms;
- laws, regulations and permits; and
- events, travel conditions and the wider economy.
6.4What this means for Owners
Occupancy, bookings or income lower than an Owner expected are not, in themselves, a breach of our obligations. Each Owner decides for themselves whether holiday-home use suits their Property.
7Responsibility and liability
Link to section 77.1Liability that cannot be limited
Nothing in these terms excludes or limits liability for fraud, wilful misconduct or gross negligence, for death or personal injury, or any other liability that cannot be excluded or limited under the laws of the United Arab Emirates.
7.2The Website
To the extent permitted by law, BARIQ is not liable for any loss arising from reliance on the general information on the Website, from demonstration listings or illustrative photographs, from the Website being unavailable, or from third-party websites and services.
7.3Limits on our liability
Subject to clause 7.1, and to the extent permitted by law:
- we are not liable for indirect or consequential loss, or for loss of profit, income, business or opportunity;
- our total liability to a Guest in connection with a stay is limited to the total price paid for that stay. This limit does not apply to a refundable security deposit, or to refunds due to the Guest under these terms or the Booking Confirmation; and
- our total liability to an Owner in connection with a Property is limited to the management fees BARIQ received for that Property in the twelve months before the event giving rise to the claim, unless the Management Agreement provides otherwise. This limit does not apply to Rental Revenue or other money that BARIQ has collected or holds for the Owner, which we pay over or account for as the Management Agreement provides.
Nothing in these terms limits the rights a Guest has as a consumer under Federal Law No. 15 of 2020 on Consumer Protection and its implementing regulations.
7.4Guests' responsibility
Guests are responsible for loss or damage caused by them, their party or their visitors, and for fines or charges resulting from their conduct. Guests are responsible for their personal belongings, and we are not liable for their loss or damage unless it is caused by our negligence.
7.5Owners' responsibility and insurance
Owners are responsible for the condition, safety and legal compliance of their Property, and for keeping it suitably insured. BARIQ is not responsible for damage caused by Guests, but we will reasonably help the Owner to recover it, for example from the security deposit, from the Guest, or through a booking platform's or an insurer's claims process.
7.6Compensation for breach
If you breach these terms or the law, you agree to compensate BARIQ for the reasonable losses, fines and costs we incur as a direct result, to the extent that they are caused by you. Each party remains responsible for its own acts and omissions.
7.7Force majeure
Neither BARIQ nor you is responsible for a failure or delay caused by events beyond reasonable control, such as natural events and extreme weather, fire, flooding, epidemics, government actions or restrictions, war or civil unrest, or failures of utilities, telecommunications or building systems not caused by that party. The affected party will notify the other promptly and take reasonable steps to limit the effects. If we cannot provide nights you have paid for because of such an event, we will refund the amounts paid for those nights, as described in clause 3.11.
8Governing law and disputes
Link to section 88.1Governing law
These terms, and any booking or dispute arising from them or from the use of the Website, are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai.
8.2Resolving concerns amicably
If you have a concern or a complaint, please contact us first (see section 10). We will look into it and try to resolve it amicably, fairly and promptly.
8.3Courts
If a dispute cannot be resolved amicably, the courts of the Emirate of Dubai have jurisdiction, unless a Management Agreement provides for another method of dispute resolution. This does not affect any right you have to refer a complaint to the competent authorities, including the consumer protection authorities and the Department of Economy and Tourism in Dubai.
9Changes and general terms
Link to section 99.1Changes to these terms
We may update these terms from time to time. The updated version is published on this page with a new "Last updated" date and applies to the use of the Website from that date. Confirmed bookings and signed Management Agreements continue on the terms agreed at the time, unless the parties agree otherwise or the law requires a change.
9.2Language
These terms are published in English and Arabic, and both versions are intended to have the same meaning. If there is any difference between them, the English version prevails, except where the laws of the UAE require the Arabic version to prevail.
9.3Severability
If any part of these terms is found to be invalid or unenforceable, it will be applied to the fullest extent permitted by law, and the rest of these terms remains in full effect.
9.4No waiver
If we do not enforce a right under these terms, or delay in doing so, we have not given up that right.
9.5Transfer
We may transfer our rights and obligations under these terms to another company as part of a reorganisation or a transfer of our business, provided that your rights are not reduced as a result.
